The operator TIM was forced to pay compensation of R$25,000.00 (twenty-five thousand reais) in moral damages to a customer who had his WhatsApp cloned. Upon accessing the victim's account, the attacker used the contacts to ask for money and the user appealed to the courts to have the operator sentenced.

The judge responsible for the case and decision pointed out that the company TIM is part of the consumer chain and failed to monitor uk mobile database procedures against fraudsters correctly. The telephone company, on the other hand, defended itself by stating that it does not have access to customers ' WhatsApp accounts , which require confirmation via SMS from the owners to be installed.

The first instance court had previously stated that there was no failure in the company's services , since the fraud was committed by third parties. It then ruled the claim as inadmissible. Shortly after, the plaintiff filed an appeal, which was accepted by another judge.

The reporting judge, Alexandre Malfatti, stated in his decision that the operator directly benefited from the partnership established with WhatsApp. The judge also stated that TIM has “insufficient control over the security procedures related to the use of its service, characterizing a lack of concern for the consumer”. In view of this decision, the company will have to pay compensation for consequential damages in the amount of
R$10,000.00 (ten thousand reais) and for moral damages in the amount of R$15,000.00 (fifteen thousand reais).

Last year, operators Vivo and Claro were also sued for lack of security and cloned WhatsApp accounts.
